McDonalds’ 24-hour opening application

McDonalds has sought confirmation that its Spalding restaurant and drive-thru can open 24 hours a day.
The restaurant, which reopened at the beginning of the month following a refurbishment, is currently closed from midnight to 5am.
An application submitted to South Holland District Council requests confirmation that 24-hour opening would be lawful at the Holbeach Road site.
It states no conditions were attached to a 2011 planning consent for variation of hours and unrestricted opening is therefore allowed.
The application said: “As there is no formal planning condition attached to the 2011 permission that imposes any limitations on the hours of operation, the restaurant can lawfully operate 24 hours a day. In light of the above, we request that the application is approved.
“To assist the Local Planning Authority’s assessment of the lawful nature of the proposed development, we include copies of certificates issued in respect of McDonald’s Restaurants in Tonbridge, Weymouth, Birmingham and Dagenham. The principle considered in these recent examples is identical to that central to this application.”
The Spalding restaurant now offers digital ordering points and table service.
