A Crowland man has avoided a driving ban after pleading guilty to being in charge of a car when drunk.
Samuel Pinnelli, 22, of West Street admitted to being in charge of the Ford Kuga in Godsey Lane, Market Deeping whilst over the limit, when he appeared at Boston Magistrates Court.
Jim Clare, prosecuting, said police saw him sitting in the car with the engine running in the early hours of May 15 and spoke to him.
He gave a positive breath test with a reading of 62 microgrammes of alcohol in 100 millilitres of breath. The legal limit is 35.
Mitigating, Suleman Baig said Pinnelli and his partner were arguing because his partner’s mother had telephoned them as they were driving home and asked them to return to her home to give her some money and he didn’t want to go.
He said Pinnelli had pulled the car over while they were arguing and he had then drunk some alcohol that was in the car and had intended to get out of the car and go for a walk.
The magistrates told him that as this was not a mandatory disqualifiable offence, he would be given 10 points on his licence and warned him that if he was convicted of any further motoring offence in the next three years he would face a ban of six months under the totting up procedure.
He was also fined £153 and ordered to pay £115 in costs and charges.
