A Spalding man who admitted supplying cannabis has avoided jail after he was given a final chance by a judge.
Tristan Boon, 29, of Regent Street, was ordered to appear before Lincoln Crown Court after he breached a suspended prison sentence which was passed on him in February.
The court heard Boon was originally sentenced to eight months imprisonment suspended for 18 months after he pleaded guilty to supplying the Class B drug and attempting to fraudulently evade duty.
As part of the sentence Boon was ordered to co-operate with the Probation Service and regularly attend his appointments.
Judge Catarina Sjolin Knight had adjourned sentence on Boon for five weeks to test his compliance with the requirements of the Probation Service.
Katie Attenborough, prosecuting, told the court there had been a significant improvement in Boon’s compliance with the Probation Service and he had attended all of his appointments.
Previously the court heard Boon failed to attend his first Probation appointments on 6 February and 12 February, and then admitted a second breach.
Neil Sands, mitigating, urged the court not to activate Boon’s eight month jail sentence
Mr Sands told the judge: “Your honour took a chance on Mr Boon, although there is still along way to go with the drugs tests.”
Judge Sjolin Knight agreed not to activate the suspended jail and fined Boon £250 for the breach of his Probation order.
The judge told Boon: “You have shown me that you can comply with the order.
“You have done really well and it is nice to be able to say that to you.”
