Spalding man accused of attempting to kidnap ‘girlfriend’s’ husband

A woman attempted the kidnap of her own husband aided by her ‘boyfriend’ from Spalding, a court was told.

Lucy Leggate, 35, a mother-of-four from Fishtoft, denies attempting to kidnap Gary Leggate on September 22, 2022.

She is jointly charged with Daniel Algar, 41, of Second Avenue, Spalding who is on trial alongside her at Lincoln Crown Court.

Jurors heard police were called to the A52, near Swineshead, shortly after 10pm on September 22 after Mr Leggate’s Ford S-Max suddenly came to a halt on the wrong side of the road.

The court heard Mr Leggate had left work at the nearby Reflex Labels printers just a few minutes earlier and was being followed by a work colleague who saw a “masked man” emerge from the back of his stationary car. 

In her statement, which was read out in court, the witness said she was “immediately concerned” for Gary after he ran from the car with an arm flailing.

She described how a masked man first “appeared to run after him” and then changed direction.

The woman said she asked Mr Leggate if he was ok and he replied “someone was in my car.”

She added: “He (Mr Leggate) was in a right state “

Mr Leggate said he knew it was a man called Dan from Spalding, the witness stated, who had an affair with his wife. 

When police arrived at the scene they confirmed Mr Leggate appeared “very shaken and upset.”

The jury were shown CCTV footage of a hooded figure walking near Mr Leggate’s car and his lights coming on just a few minutes before he left work at 10pm. 

Police found no DNA evidence which showed Mr Algar had been in the rear of Mr Leggate’s car but there were polyester fibres present which were similar to his work trousers, the jury heard.

Mobile phone records showed Mr Algar had made two short calls to Mrs Leggate on the morning of September 22, it is alleged.

A longer call of 42 minutes was also made by Mrs Leggate to Mr Algar at 9.27pm on the same day, it is claimed.

Mr Algar was arrested the following day on suspicion of attempted kidnap after police stopped his works van.

During three police interviews Mr Algar admitted being in a relationship with Mrs Leggate, describing them as “boyfriend and girlfriend,” but he denied being the man in her husband’s car. 

Daniel Algar, of Second Avenue, Spalding, and Lucy Leggate, of Church Green Close, Fishtoft, both deny the  attempted kidnap of Gary Leggate.
