A fracas outside a Spalding takeaway almost 18 months ago, has resulted in a 21-year-old man appearing in Boston Magistrates Court to face a charge of causing actual bodily harm.
Diogo Correia-Carneiro of Danube Square admitted assaulting Carl McCartin occasioning actual bodily harm.
Marie Stace, prosecuting, said Mr McCartin and his wife had been out for the evening together on August 23, 2020, and had stopped at the Hot Spice takeaway for a meal on the way home, but while waiting outside, a fight developed involving Correia-Carneiro and another man, who was not identified.
Ms Stace said that after this, Mr McCartin appeared to aim a kick towards Correia-Carneiro at which Correia-Carneiro danced around him like a boxer and hit him once and Mr McCartin fell to the ground injuring his shoulder.
She said Mr McCartin still suffered from pain more than a year later and was due to have an operation to remove a pin installed in his shoulder.
Ms Stace admitted in interview with the police that the defendant should not have hit Mr McCartin and that he was drinking excessively.
Mitigating, Vicky Clayton said Correia-Carneiro was punched by the third party who had not been prosecuted at all for his part and said he had only thrown a single punch at Mr McCartin.
The magistrates adjourned the case for sentence on March 2 and ordered a pre-sentence report from the Probation Service.
