A boundary dispute between Donington neighbours has led to one of them appearing in court charged with damage.
Philip Gardner, 38, of Station Street admitted causing £10 worth of damage to a fence belonging to his neighbour when he appeared at Boston Magistrates Court.
Prosecuting Dale Brownless said it was a neighbours’ dispute which should never have got so far as to get to court.
He said that there was a dispute between Gardner and his neighbour, Darren Clarkson, over where the boundary was and while he was on the phone to the police to try and resolve the matter, Gardner lost his temper and went out and kicked a fence panel Mr Clarkson had erected, damaging it.
Mitigating, David Eager said it was an ‘unfortunate incident’ and if Gardner had had ‘robust advice’ from a solicitor, he would have had a caution or a resolution within the community.
He said Gardner was ‘sick and tired’ of not being able to resolve it by showing his neighbour the deeds and he went and kicked the fence.
Gardner was given a six month conditional discharge and ordered to pay £10 compensation and £107 in court costs and charges.
