Jail sentences after man’s head stamped on outside Spalding nightclub

A man was left with a fractured skull and face after he was repeatedly stamped on during a fight outside a Spalding nightclub, Lincoln Crown Court was told.
 
Kristaps Zarins (31) became involved in an argument with a group of people while waiting to go into the Loaded nightclub.
 
Mr Zarins punched Vasilijus Klimek but was then attacked and ended up lying unconscious on the ground after being struck by Dovydas Bagdonas.
 
Mark Watson, prosecuting, said that as Mr Zarins lay helpless on the floor, Klimek stamped on his head a number of times.
 
Mr Zarins suffered a fractured skull and fractures to bones in his face. He spent three days in intensive care and has since returned to his home country of Latvia for medical treatment.
 
Klimek (29) of Pennygate, Spalding, admitted a charge of affray as a result of the incident on 25 February 2018. He was jailed for 12 months.
 
Judge Andrew Easteal told him: “It is indisputable that when you were confronted with Mr Zarins prone and unconscious on the floor and utterly unable to defend himself you stamped upon his head repeatedly and attacked him quite venemously.”
 
Bagdonas (31)  of Grevel Close, Spalding, admitted assault occasioning actual bodily harm. He was given an eight-month jail sentence suspended for 18 months and a 16-week night-time curfew. 
 
Laura Hocknell, for Klimek, said he had suffered provocation as Mr Zarins started the violence by punching him.
 
She told the court: “It is plain that Zarins throws the first punch at Klimek. What Mr Klimek accepts is that he then goes way over the top.
 
“At the time of this offence binge drinking was a problem for him. He has cut down substantially since. He has joined a gym and has been trying to live a more healthier lifestyle.”
 
Diane Mundill, for Bagdonas, said his involvement was a punch for which he has since shown remorse. She urged that any prison sentence should be suspended.
