Man accused of kidnapping girlfriend’s husband tells court it wasn’t him in car

A man who denies attempting to kidnap his girlfriend’s husband insisted he was not the “masked” person who hid in his car.

Daniel Algar, 41, from Spalding, is on trial longside Lucy Leggate, 35, a mother-of-four from Fishtoft, near Boston.

Both are jointly charged with attempting to kidnap Mrs Leggate’s husband, Gary Leggate on September 22, 2022.

Lincoln Crown Court heard Mr Leggate was driving home from work on the A52 near Swineshead when a “masked man” suddenly appeared in the rear of his Ford S-Max.

Jurors heard Mr Leggate ran from his car after coming to a halt on the wrong side of the road.

The prosecution allege Mr Algar was the hooded figure who was spotted on CCTV walking towards Mr Leggate’s car just a few minutes before he left his place of work at nearby Reflex Labels.

Mr Algar admitted being involved in a relationship with Mr Leggate’s wife when he was arrested the next day but denied being the masked person in her husband’s car.

During two police interviews conducted on September 23 2022, Mr Algar explained that Mr Leggate was not happy with the things going on between himself and Lucy.

Mr Algar said they described each other as “boyfriend and girlfriend.”

But Mr Algar denied he was aware of anything happening to Gary on September 22 and insisted he was not in Swineshead on that date.

When asked if there was any plan with Lucy to cause any harm to Gary or to “take him away” Mr Algar replied: “Definitely not.”

Mr Algar said he only went out to get petrol from a Morrisons service station in Pinchbeck on the night of the alleged attempted kidnap and confirmed he had spent much of the day on the phone to Lucy.

He denied being the hooded person filmed on CCTV near Mr Leggate’s work and said he had not seen him for two months.

When asked why Mr Leggate said he recognised his voice as the man in the car Mr Algar said it was motivated by what was going on with him and Lucy.
