A robber who failed to complete his community service after stealing an iPhone from a youth he’d seen be assaulted at Spalding railway station has been given a last chance to avoid jail.
Conner McKue, 22, was sentenced to a two year community order in March last year after he admitted a charge of robbery.
As part of the sentence McKue, of Viscount Close, Spalding, was ordered to complete 150 hours of unpaid work and 40 rehabilitation activity requirement days.
But a hearing at Lincoln Crown Court was told McKue had failed to complete his hours of unpaid work and the Probation Service now wanted him to be re-sentenced.
Judge Catarina Sjolin Knight had warned McKue that he was in real danger of being jailed.
But Judge Sjolin Knight agreed to give McKue a further three months to complete his order after being told he had problems securing stable accommodation and had endured a difficult childhood.
McKue was also fined £150 and must complete five additional rehabilitation activity requirement days.
The court heard McKue took the iPhone from a 17-year-old youth after he was beaten up by another man at Spalding railway station.
McKue had stood away from the attack as the victim was kicked and punched on February 12, 2022.
But the incident was caught on CCTV and showed the other man taking the victim’s watch before leaving the scene.
McKue could then be seen approaching the victim while he was still on the floor and taking his iPhone.
He later threw the iPhone on the ground and volunteered his identity to the police when they attended.
Judge Sjolin Knight had imposed the two year community order on McKue after saying she was satisfied that he was not involved in the violence.
The court heard McKue had complied well with a previous community order made on him for two burglaries.
