A Spalding doorman who caused a catalouge of injuries to a customer’s face when he gave him a “hard shove” to the ground was spared jail and ordered to pay £1,920 compensation.
Jacob Mizio (31) was working at the XO nightclub when he pushed Mateusz Ignas to the floor outside the Westlode Street premises.
Lincoln Crown Court heard Mr Ignas woke up in hospital after suffering a number of fractures to the left side of his face, a black eye, a broken nose and a lost tooth.
Jonathan Dunne, prosecuting, said Mr Ignas had been out in Spalding celebrating the birth of his child when he visited the nightclub with a number of friends.
The court heard none of group appeared to be doing anything wrong and Mizio could be seen engaging with Mr Ignas and his cousin after they left the club.
Mr Dunne told the court CCTV then showed as “clear as day” Mizio pushing Mr Ignas to his left shoulder.
It caused Mr Ignas to stumble and fall to the pavement face first.
“It is a hard shove,” Mr Dunne added.
A second push from Mizio caused the cousin of Mr Ignas to fall on top of him.
In a victim impact statement which was read out in court Mr Ignas explained that his nose was still out of alignment and he had difficulty eating because of the injury to his tooth.
Mr Ignas said he was not someone who caused trouble when out.
“I still haven’t been out in the evening because I don’t want any trouble,” Mr Ignas added.
Mizio, of Double Street, Spalding, pleaded guilty to inflicting grievous bodily harm on May 15, 2022.
In mitigation the court heard Mizio had no previous convictions and was well respected by his colleagues in the security industry.
Passing sentence Judge Catarina Sjolin Knight told Mizio: “Mr Ignas from what I can see had not been behaving in an aggressive fashion. Neither was his cousin.
“As a member of the door staff you would know a drunk patron is more vulnerable.”
However Judge Sjolin Knight said it was clear Mizio was a family man without previous convictions who had deeply reflected on his actions and shown remorse.
“Following your guilty plea it is very unlikely you will be able to return to that work,” Judge Sjolin Knight added.
Mizio was sentenced to 14 months’ imprisonment suspended for 18 months and must also complete ten rehabilitation activity requirement days.
He was also ordered to pay compensation of £1,920 to Mr Ignas to help pay for his dental treatment.
