Man found guilty of intentional strangulation after being cleared of rape

A Spalding man has been cleared of raping a woman but found guilty of intentional strangulation and suffocation.

Zigbeniew Kaczmaek, 51, of Carrington Road, Spalding,  was found not guilty of two rape charges after a trial at Lincoln Crown Court.

But jurors convicted Kaczmaek of three charges including intentional strangulation and intentional suffocation. Both offences occurred in December last year.

During the eight day trial jurors were directed to find Kaczmaek not guilty of two other rape charges and no evidence was offered on an assault charge.

Kaczmaek, who had no previous convictions, denied all the charges and will be sentenced at Lincoln Crown Court on December 13.

Chris Jeyes, defending Kaczmaek, said he had been in custody throughout the proceedings and he would not be asking for a Probation report on his behalf.

“There is not a lot more to know about Mr Kaczmaek, a part possibly from his previous use of alcohol, but he has of course had now a 12 month period of abstinence,” Mr Jeyes explained.

The trial judge, Judge James House KC, remanded Kaczmaek back into custody and said he would be assisted by an impact statement from the victim, who can not be named to protect her anonymity.

Judge House told Kaczmaek: “I am adjourning your case for sentence. I am not asked for a pre-sentence report and I don’t order one.

“But it is better for a period to reflect on matters, so I will sentence you on December 13.

“As I indicated to your counsel these are still serious matters and a custodial sentence will be at the forefront of my mind.”
