Magistrates have heard a Spalding man who could ‘barely stand up’ when he got out of his car following a collision, failed to give breath or blood samples at the roadside and the police station.
Eduards Novikovs, 48, of Winsover Road, admitted failing to provide a specimen when he appeared at
Boston Magistrates Court.
Prosecuting, Marie Stace said police had been told of a potential drunk driver following a collision in
Winsover Road at 10.28pm on March 13, and found Novikovs driving slowly along Winsover Road.
He was arrested after failing to provide a breath sample.
She said that he also failed to provide samples at the police station and had to be warned about his
behaviour after making ‘inappropriate comments’ to the interpreter assisting him.
She said he claimed to have Hepatitis C which was why he could not give a blood sample but she said
that was not an acceptable reason in law.
Mitigating, Philippa Chatterton said it had not been a deliberate refusal and there had been an error with
the breath machine at the police station and he was nervous about giving a blood sample because of his
Hepatitis C.
She added that Novikovs had not fully understood the procedure at the roadside.
He was banned from driving for two years but was offered the drink drivers’ rehabilitation course which
will reduce the period of the ban by 24 weeks.
He was also fined £425 and ordered to pay a total of £127 in court costs and charges.
